The Failure of the 28-Article Ceasefire Plan for Ukraine: How Diplomatic Efforts Continue to Falter

Europe experienced widespread relief on Monday, as the tension triggered by the announcement of a new 28-article proposal for resolving the conflict appeared – temporarily – to have been defused. A Washington representative spoke of "notable headway" after Ukraine-US talks in Geneva. On Monday night, Russian leadership made its response: an extensive attack of aerial bombardment on Kyiv.

The Cycle of Negotiation and Warfare

The sequence of conflicting incidents captured the harsh reality of the outgoing year. By day, negotiation efforts are conducted: positive announcements are delivered from multiple capitals. Considerable effort is devoted on restraining particular approaches. By night, the Kremlin clearly shows the world that, for them, conflict continues to be the main instrument for achieving "peace".

Nocturnal Warfare

As Russia's attack unfolded into the early hours of Tuesday, the present situation of Ukraine's exposure was revealed. Ukraine is equipped to monitor rocket firings from Russian territory, a capability provided through up-to-date information. From witness perspectives, Ukrainian air force fighter jets that had been scrambled to intercept incoming aerial threats flew past – sophisticated military planes provided to Ukraine by European allies.

Soon thereafter, Kyiv's anti-aircraft weapons engaged: multiple launches deployed against a incoming threat. This was a modern interception technology at work, probably provided by allied countries. Every launch shakes the surroundings, rattling buildings. The instant of fear quickly transforms into grim resignation: perhaps the incoming missile won't strike its target this time, protecting urban areas from ruin and further power outages.

Ongoing Risks

Soon after, a large-caliber weapon fired at a aerial vehicle in the vicinity, part of a rapid response unit – most likely imported technology. Sadly, the bullets missed the hostile drone – it continued its flight toward its objective.

With pauses, this persisted until dawn. Kyiv faced the morning news: seven people killed, destruction and infrastructure problems in numerous residences as a result of the evening attack. As customarily, everyone still went about their day – living the war. But those full day demonstrated Ukraine's critical military reliance on international aid – a dependence that European nations are clearly incapable to substitute in the short term.

Ineffective Peace Efforts

The detailed framework from American leadership generated strong feelings, debate and serious worry – and momentarily shifted focus from Ukraine's major integrity crisis in years. Yet, we have experienced comparable situations, after earlier high-level meetings and international summits.

Every new approach from Washington unfolds according to the same pattern: a negotiation push against Ukraine, which Kyiv, with partner nations, effectively counters. They manage the tension but never actually win the battle. This pattern will, undoubtedly, persist.

Tactical Assessments

It is convenient to criticize certain parties of persistently promoting Moscow's conditions. But that does not seem to be the whole story. American leadership works based on a principle familiar among experienced diplomats: you cannot achieve through diplomacy what you have failed to defend militarily. The US administration assumes that it is unfeasible to force Russia to relinquish the territory that it presently holds in Ukraine's occupied territories.

The issue is that while recognising this factual reality, American administration does little to deter Moscow, through words or deeds, from believing that the current condition will not change more in its favour in the coming year.

Divergent Views

Therefore, the Kremlin is confident that duration works to their advantage – that Ukraine and its supporters are nearing depletion. Their motivation to agree to terms that does not give them the maximum possible gain is close to zero. There may be many attempts to achieve ceasefire, but they will continue as long as Russia's leader remains highly assured in the result.

On the contrary, Kyiv believes that Ukraine can still endure, slowly losing civilians and areas but averting a total frontline collapse until circumstances change in its favour.

Present Conditions

Factually, there are no genuine requirements for a armistice. Now, individual motivations are coming into play: political desires to mediate resolution and obtain worldwide acknowledgment, and the government's dual difficulties – on one hand, not to alienate a key ally, and on the other, to unite the population around the national cause against any plan Kyiv finds unacceptable, so that their priority does not move to homefront challenges. And although their mission will now be significantly challenging after latest incidents, it remains very improbable that this will alter their fundamental strategy.

These two forces are driving the talks.

Summary and Prospects

It took a mere seven days to terminate the 28 points of the current initiative. Forceful and unpredictable management of the matter by American leadership, resistance by Ukraine and the rest of Europe, along with soothing efforts of diplomats, and finally, current information leaks, all served their function.

While new initiatives based on previous concepts are imminent, Kyiv, London and other allied nations should draw one fundamental conclusion: Ukraine and Europe will only be able to fend off diplomatic offensives from Washington that are based on Russian demands and demonstrate specific hesitation to alter the situation, if they stand together and strengthen their defence capabilities at a considerably quicker tempo. If they do, neither external pressure nor military threats will be able to break them. In the meantime, Ukraine's capacity to defend against evening bombardments will, for the coming months, largely rely on continued Western support.
